1099reporter Electronic Delivery Agreement
YOUR EMPLOYER setup secure electronic delivery for your 1099 MISC via Kickstart Solutions, LLC/dba/1099reporter (hereafter 1099reporter). This agreement confirms you consent to electronic delivery of your tax information. If you decline, 1099reporter will mail you a copy of your 1099 MISC (if YOUR EMPLOYER provided your address). 1099reporter mails 1099s at the end of January and the middle of each subsequent month.
The following terms and conditions apply to the delivery, receipt and review of your electronic 1099 form(s) via the 1099reporter service. By your continued use of 1099reporter you consent to these terms, which may be updated and posted on our site periodically.
Consent to Electronically Delivered 1099 Forms (Information Returns)
1099reporter provides information reporting services via the Internet. By consenting to this agreement you accept electronic delivery of all information returns (defined below), other than those you have specifically requested be delivered in paper form. "Information returns" include all current and future 1099s, W-2s and other information, documents, data and records regarding 1099reporter information returns. This consent is effective immediately and will remain in effect unless and until 1099reporter revokes such consent.
You are responsible for reviewing all notices
You represent that you will access or download the relevant documents or information promptly. It is your responsibility to review, all confirmations, statements, notices and other communications whether delivered to you by U.S. Mail, email or other electronic means. All information contained therein shall be binding upon you.
Waiver of U.S. Mailed Delivery of Notices
By consenting to electronic delivery of binding communications, including confirmations and statements, you agree to the termination of distribution of such notices by U.S. Mail. You agree that 1099reporter fulfills its legal obligation to deliver any such document if sent electronically. Documents sent electronically will contain all the information as it appears in the printed hardcopy version as prepared and distributed by the originator, with possible changes to format and graphic insertions such as photographs or logotypes. Electronic delivery may be in the form of email, email attachment or download from the 1099reporter website, or the website or Internet location of an authorized agent of 1099reporter.
You must notify us if you cannot receive electronically delivered documents
Should you experience difficulty opening a document electronically and fail to access the electronic form in a timely manner, a paper 1099 Form will be sent to your postal mail address of record.
Notwithstanding the above process, 1099reporter may terminate electronic delivery at its discretion at any time and resume delivery of mailed forms.
Hardware or Software Requirements Needed to Access Electronic Records
You understand that to receive electronic delivery of notifications you must have Internet access, a valid email address, the ability to download and install such applications as 1099reporter may specify and a printer or other device to print or save any information you want to retain. Potential costs associated with electronic access to your account include charges for Internet access providers (ISPs) and telephone companies. 1099reporter does not charge additional online access fees to retrieve electronic information returns.
Headings are for Descriptive Purposes / Severability / Other Terms
The heading of each provision hereof is for descriptive purposes only and shall not be deemed to modify or qualify any of the rights or obligations set forth in each such provision. If any provision or condition of this Agreement shall be held to be invalid or unenforceable by reason of any law, rule, administrative order or judicial decision by any court, or regulatory or self-regulatory agency or body, such invalidity or unenforceability shall attach only to such provision or condition. The validity of the remaining provisions and conditions shall not be affected thereby and this Agreement shall be carried out as if any such invalid or unenforceable provision or condition were not contained herein. The terms of this agreement shall be in addition to the terms and conditions contained elsewhere on the 1099reporter site and shall not supersede the rights or obligations contained in such other agreements.
